I understand:

1. If purchasing an OpenMyStore web store solution. I am responsible for both the one-time set-up fee and a choice of the monthly service plan or the yearly service plan.
2. Set-up fee is non-refundable. Cancellation must be made from PayPal and only cancel the next subscription period. There will be no refund or early termination made for subscription. For example, if you have the monthly subscription plan, you can cancel it before the next monthly subscription begins. If you have a yearly subscription plan, in order to cancel,  you have to wait before the next year renewal subscription begins. As a result, there will be no refund on the period that you subscribe for.
3. I will be given all of the tools needed to setup my site content and information to my site. Doing so is my responsibility.
4. I understand that OpenMyStore.com uses "AVID PURE" as its PayPal account to process my subscription order for this service.
5. I understand that it is my responsibility to promote and advertise my own store(s).
6. I understand that OpenMyStore.com does not make any claims or guarantee on your earning. All income and earning are proceed by your affiliate partners. Please refer to your affiliate partners for more information about earning and its referral fee schedule.
7. I have read and understand the Web Site Service Agreement in its entirety.

Open My Store Web Site Service Agreement

This Web Site Agreement ("Agreement") is by and between OpenMyStore.com and You, Your heirs, assigns, agents and contractors ("You") and is effective as of the date of electronic execution. This Agreement sets forth the terms and conditions of Your use of OpenMyStore.com's Web Site services (collectively, the "Services") and represents the entire agreement between You and OpenMyStore.com. By using the Services, You acknowledge that You have read, understand and agree to be bound by all the terms and conditions of this Agreement, along with any new, different or additional terms, conditions or policies, including the Universal Terms of Service which OpenMyStore.com may establish from time to time.
In addition to transactions entered into by You on Your behalf, You also agree to be bound by the terms of this Agreement for transactions entered into on Your behalf by anyone acting as Your Agent, and transactions entered into by anyone who uses the account You've established with OpenMyStore.com, whether or not the transactions were in Your behalf.

Description of Service

OpenMyStore.com currently provides the Services to its customers for a monthly fee. OpenMyStore.com will host your web site on OpenMyStore.com' servers, provided, however, you abide by the terms and conditions set forth herein and in each of OpenMyStore.com' policies and procedures.

Availability of Services

Subject to the terms and conditions of this Agreement, OpenMyStore.com shall attempt to provide the Services for twenty-four (24) hours per day, seven (7) days per week throughout the term of this Agreement. You agree that from time to time the Services may be inaccessible or inoperable for any reason, including, without limitation:
1. equipment malfunctions;
2. periodic maintenance procedures or repairs that OpenMyStore.com may undertake from time to time; or
3. causes beyond the control of OpenMyStore.com or that are not reasonably foreseeable by OpenMyStore.com, including, without limitation, interruption or failure of telecommunication or digital transmission links, hostile network attacks network congestion or other failures.
You agree that OpenMyStore.com has no control of availability of the Services on a continuous or uninterrupted basis.

Web Site Content

You shall be solely responsible for providing information for your web site and any and all pages, data, works, information and/or materials on, within, displayed, linked or transmitted to, from or through your web site, including, without limitation, trade or service marks, images, photographs, illustrations, graphics, audio clips, video clips, email or other messages, meta tags, domain names, software and text. Your web site content shall also include any registered domain names provided by you or registered on behalf of you in connection with the Services. In no event shall your web site consist of the following:
1. pornographic, obscene or excessively profane content;
2. content intended to advocate or advance computer hacking or cracking;
3. gambling;
4. illegal activity;
5. drug paraphernalia; or
6. hate, violence or racial or ethnic intolerance.
Inclusion of any of the above forbidden content materials will be cause for immediate suspension of your website without refund. OpenMyStore has the sole authority to cancel any website for any reason, without notice, including, but not limited to having content as listed above.

Domain Name

You will register the available domain name of your choice on your behalf. This domain name will be your property and will be listed with the registration contact information as that which you provide to us. Additional service fee may be requested if you want us to do any domain service for you. At any time, you may transfer the domain name to another provider. Doing so is solely your responsibility. You may also point a domain parked elsewhere to your OpenMyStore Web Store website. OpenMyStore.com will provide the DNS information you will need to make this change. Making the change is solely your responsibility.

Affiliate with 3rd party companies

Our service utilize both Google Adsense and Amazon Associates, it is your responsibilities to obey their policies. We do not responsible any consequences between you and the 3rd party companies. It is also your responsibilities for you to create accounts from them.
You agree that the prevailing party shall be awarded all costs of bringing a claim, including reasonable attorney fees and the ordinary costs and expenses incurred in resolving the dispute. You agree that all claims shall be brought in California. This Agreement shall be interpreted under the laws of the State of California.

Disclaimers

It's your responsibility for you to upload your own images for top banner section of the store and your own logo, and not to violate any copyright laws. All images, files, and software distributed by OpenMyStore.com are provided on an "as is" and ¡§as available" basis and without warranties or conditions of any kind either express or implied. OpenMyStore.com assumes no responsibility for any actions or liabilities arising from their possession or use. OpenMyStore.com disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose. Under no circumstances shall OpenMyStore.com or its content providers be liable to you or any third-party for any indirect, consequential, incidental, special or punitive damages, including but not limited to lost profits and business interruption, irrespective of the type of cause of action, arising in any way from use of the images or website, even if OpenMyStore.com is expressly advised of the possibility of such damages. In no event shall OpenMyStore.com's liability exceed the fees paid for the use of the files. No oral advice or written information provided by OpenMyStore.com, its content providers or the like, shall create a warranty; nor shall you rely on any such information or advice. You acknowledge that this paragraph shall apply to all content, images, and services available through OpenMyStore.com. In those states that do not allow the exclusion or limitation of liability for consequential or incidental damages, liability is limited to the fullest extent permitted by law.

Storage and Security

At all times, You shall bear full risk of loss and damage to Your web site and all of Your web site content. You are entirely responsible for maintaining the confidentiality of Your password and account information. You agree You are solely responsible for all acts, omissions and use under and charges incurred with Your account or password or in connection with the Site or any of Your web site content displayed, linked, transmitted through or stored on the Server. You shall be solely responsible for undertaking measures to: (i) prevent any loss or damage to Your web site content; (ii) ensure the security, confidentiality and integrity of all your web site content transmitted through or stored on OpenMyStore.com servers; and (iii) ensure the confidentiality of Your password.

Revision of Conditions of Use

OpenMyStore.com may revise this Agreement at any time and such revision shall be effective immediately upon the posting of the revised Agreement on the Website. You agree to review the Agreement prior to the licensing of an image to make yourself aware of such revisions. If any such revision is unacceptable to you, you may terminate your membership by notifying OpenMyStore.com Support of your desire to terminate by e-mail. Your notice of termination will be effective upon receipt by OpenMyStore.com.
